Announcement Of The Ministry Of Commerce On Terminating Anti-Dumping Measures Against Caprolactam

In 2003, the Ministry of Commerce of People's Republic of China issued the Announcement No. twenty-second of the year, announcing anti-dumping duties on imported caprolactam originating in Japan, Belgium, Germany, Holland and Russia.

The implementation period of anti-dumping duty has been 5 years since June 6, 2003.

In September 3, 2007, the Ministry of Commerce of People's Republic of China issued the Announcement No. seventieth of the year, announcing that the dumping and dumping margin of imported caprolactam originating in the Russian open world Limited by Share Ltd were investigated.

According to the forty-eighth provision of the anti dumping regulations of the People's Republic of China, the time limit for the collection of anti-dumping duties and the time limit for performance of price commitments shall not exceed 5 years; however, after the reexamination, it is concluded that the termination of the anti-dumping duties may result in the continuation or recurrence of dumping and damage, and the time limit for the collection of anti-dumping duties can be appropriately extended.

In December 3, 2007, the Ministry of Commerce issued the Announcement No. 102nd of 2007, announces that the anti-dumping measures applicable to the import of caprolactam originating in Japan, Belgium, Germany, Holland and Russia will be terminated in June 6, 2008, and stipulates that, from the date of the announcement, the natural persons, legal persons or related organizations of the domestic industry or representing the domestic industry may submit a formal final review application to the Ministry of Commerce in written form 60 days before the termination date of the anti-dumping measures.

Within the time limit prescribed by the notice, the Ministry of Commerce has not received the application for final review submitted by the natural person, legal person or related organization in the domestic industry or on behalf of the domestic industry according to the provisions of the notice.

The Ministry of commerce also decided not to initiate the final review.

In view of this, since June 6, 2008, the anti-dumping duty on imported caprolactam originating in Japan, Belgium, Germany, Holland and Russia has been terminated.

At the same time, it will terminate the interim review of the dumping and dumping margin of caprolactam for the Russian open Limited by Share Ltd.
